Product and subscription terms

These product terms describe the purchase of HMOOD Reviews Stand and the use of HMOOD Insights. They supplement HMOOD’s general terms where relevant.

1. Supplier and contact

The supplier is HMOOD DIGITAL, a Norwegian sole proprietorship, organisation no. 938 373 310 (“HMOOD”), registered in the Central Coordinating Register for Legal Entities (Enhetsregisteret). HMOOD is not currently registered in the Norwegian VAT Register.

Business address: Almveien 20, 1659 Torp, Norway. Email: hei@hmood.no. Websites: hmood.no and hmoodreviews.no. The business address is not designated as a returns address; contact HMOOD for return instructions.

2. The agreement and its scope

At launch, the products are sold exclusively to business customers (B2B). The purchaser must act on behalf of the business and have the necessary authority. The agreement consists of the offer or order details expressly accepted by the customer, these product terms and the relevant HMOOD general terms. Individually agreed terms take precedence over standard terms. For product-specific matters, these product terms take precedence over general standard provisions, including project advance payments, project cancellation and ordinary hosting and maintenance. The general terms otherwise supplement the agreement.

HMOOD Reviews Stand is ordered directly at hmoodreviews.no with payment through Stripe, without requiring an existing customer account, invitation or manual offer. The price, quantity and delivery arrangements must be available before ordering. The order becomes binding when the customer has accepted the product terms and completed payment. An abandoned or failed payment is not a completed order.

After verified payment, the customer may create or activate an account at hmood.no through secure email verification. Acceptance of portal terms concerns the individual user’s own portal use and is separate from the business’s purchase agreement. Account activation does not purchase an Insights subscription.

If HMOOD contracts with a consumer, mandatory consumer rights take precedence over these terms. HMOOD’s general business terms, including liability limitations, do not restrict those rights.

3. HMOOD Reviews Stand and price

HMOOD Reviews Stand costs NOK 490 per sign as a one-off payment. Shipping to mainland Norway is included. At launch, delivery is available only to mainland Norway.

The sign uses QR and NFC to direct visitors to the business’s Google review page. The customer must have a valid Google Business Profile and review link and check that the sign points to the correct business. Use requires a phone supporting NFC or QR, an internet connection and available third-party services.

An otherwise active sign does not require an active Insights subscription or a mandatory recurring Insights payment. Cancellation or non-payment of Insights does not in itself disable the sign’s QR/NFC link. Reviews Stand has no fixed expiry date. QR/NFC redirection is provided for as long as HMOOD operates the service. If the service is discontinued, the customer will receive reasonable advance notice, as far as practicable and in accordance with applicable obligations. Lifetime service or uninterrupted availability is not guaranteed; the sign relies on HMOOD’s redirect service and Google’s services.

4. Payment, production and delivery

The customer pays the full amount for the sign through Stripe before production starts. Required information and customisation must be agreed before production. The general project provision for a 50 percent advance payment does not apply to sign purchases.

HMOOD aims to dispatch on the next business day after verified payment, provided that the required information and customisation have been clarified. Both dispatch and delivery times are estimates, not guarantees. Dispatch is not the same as delivery; transit time depends on the carrier. Individual delivery confirmation is not required before ordering. HMOOD will inform the customer if expected dispatch or delivery is delayed. This does not limit the customer’s rights under the agreement and applicable law.

The customer should inspect the goods on receipt and report damage, missing parts or faults. This does not limit statutory rights concerning defects. Delivery and transfer of risk follow the agreement and applicable law; mandatory rules on transfer of risk apply to consumer purchases.

Prices are in NOK. VAT is not currently charged. A future change in VAT registration does not itself entitle HMOOD to change an already agreed total price; changes must follow the agreement and applicable rules.

5. HMOOD Insights – optional subscription

Sections 5 and 6 apply to Insights subscriptions once ordering has been made available and the customer has entered into a subscription agreement. HMOOD Insights costs NOK 79 per month and is ordered separately. It is delivered through the HMOOD portal at hmood.no, not the marketing website hmoodreviews.no. It shows interactions over time, NFC and QR activity and per-sign statistics for periods of 7, 30 and 90 days.

The subscription renews automatically each month until cancelled. Payments are handled through Stripe. The price, billing interval and next payment must be shown in the payment or subscription overview. Account activation or ordinary portal use does not itself create a subscription.

When electronic ordering and subscription management are available, only an active, verified user with the owner role in the organisation may start the payment process and open subscription management. That user must be authorised to act for the business. Members can use products available to the organisation without managing payment.

6. Cancellation and payment problems

For an existing subscription, an owner may use subscription management in the HMOOD portal and with Stripe once it has been made available. Ordinary cancellation stops automatic renewal, but access continues until the end of the period already paid for. There is no automatic pro rata refund. Any valid refund claims are assessed separately under the agreement and applicable law. Contact hei@hmood.no if subscription management is unavailable.

If payment fails, Stripe may retry collection. Insights access is retained while the subscription is past_due. Subscription-based access is removed when collection ends with an unpaid status or the subscription ends with a canceled status. Any separately agreed manual access is assessed independently.

Ending Insights does not itself stop an otherwise active Reviews sign. Continued access to Insights history after termination is not promised. Processing and retention of information follow the privacy notice, applicable rules and any separate agreements.

7. Faults, complaints and returns

Report faults or defects to hei@hmood.no with an order reference and a description of the problem. HMOOD must have an opportunity to investigate and handle the matter under the agreement and applicable law. Remedies may include repair, replacement, a price reduction, termination or compensation where the relevant conditions are met.

Arrange returns with HMOOD to obtain the correct return address and practical instructions. This is not a requirement for prior approval to exercise statutory withdrawal or defect-related rights. Responsibility for return costs depends on the reason for the return and applicable rules.

The customer may cancel the sign order and receive a full refund before production starts. After production starts, there is no general voluntary cancellation or return right for business purchases. Faults and defects are handled under the agreement and applicable law. General project cancellation-settlement provisions do not apply to the sign purchase.

8. Business purchases and mandatory rights

Consumer sales are not offered at launch. Restricting sales to businesses does not limit mandatory rights where they apply. This includes any statutory consumer rights; the customer’s legal status is determined by applicable law, not merely by the designation used in the order.

9. Use, rights and third-party services

The customer must use the sign and portal lawfully, keep business information accurate and protect account access. QR/NFC links must not be manipulated to mislead visitors or infringe others’ rights. Google determines its own rules for business profiles and reviews.

Buying a sign does not transfer ownership of HMOOD’s software, platform or trademarks. The customer retains rights to its own material. The right to use Insights follows the subscription or other expressly agreed access; relevant intellectual property provisions in the general terms supplement business agreements.

HMOOD Reviews is not a Google service. Google and Stripe provide independent third-party services. Changes or outages affecting those services may affect functionality. This does not release HMOOD from its own contractual obligations or mandatory liability.

10. Privacy and measurement

HMOOD’s privacy notice describes the processing of personal data. Any necessary data processing agreement is concluded separately. The privacy notice provides information about processing; it is not marketing consent.

Insights measures interactions with the sign’s links, not completed Google reviews. This feature does not give HMOOD access to the visitor’s Google account or the review itself. Multiple interactions may come from the same person and do not measure unique customers.

11. Liability, changes and disputes

HMOOD does not guarantee a particular number of reviews, positive reviews, revenue or other financial results. Visitors decide whether and what to write. HMOOD does not guarantee that Google will publish or retain a review.

For business agreements, the relevant liability provisions in the general terms apply. No new liability cap is introduced here. These references do not restrict mandatory consumer rights.

The agreed version of the terms applies to the purchase. Ongoing business services follow the general terms on written notice and cancellation rights when terms change. Mandatory rules apply to consumers. Publishing new website text does not by itself change an existing agreement.

Contact HMOOD first to try to resolve a disagreement. Business agreements follow the general terms on Norwegian law and dispute resolution. Consumers retain statutory complaint options, protective rules and access to a competent complaints body or court.
